Terms and Conditions

Article 1. Purpose

These Terms and Conditions govern use of RIHGA Members (hereinafter, "RM") provided by The Royal Hotel, Limited (hereinafter, the "Company.")

Article 2. General Provisions

  • 1. RM is a membership program (hereinafter, the "Program") that provides its members with privileges, benefits, and other services when using RIHGA Royal Hotels (hereinafter, the "Facilities.")
  • 2. Members agree to these Terms and Conditions before using the services. Upon agreeing these Terms and Conditions, members agree that the provisions of these Terms and Conditions constitute contractual provisions between the members and the Company.
  • 3. The points accumulated through the Program provided by the Company pursuant to these Terms and Conditions are referred to as the "RIHGA Members Points" (hereinafter, the "Points.")
  • 4. The Company will engage other business operators (hereinafter, a "Contractors") to provide parts of the necessary services for the management of RM.
  • 5. Notwithstanding the preceding paragraph, any and all responsibilities relating to the provision of the services of RM shall be assumed by the Facilities, and Contractors shall bear no responsibility whatsoever.

Article 3. Application for Membership

  • 1. In order to become a member of the Program, an applicant shall apply for membership to the Company after accepting these Terms and Conditions, and the related rules and regulations. Upon authorization of the application, the membership shall be granted in accordance with Article 4, thereby becoming a member of the Program. Please note that the address that a member can register with RM is limited to either a home address or work address in the country in which the member currently resides.
  • 2. In addition to the manner described in the preceding paragraph, membership to the Program can also be applied for via the RIHGA Members App provided by the Company (hereinafter, the "App,") or the My Page (hereinafter, the "My Page") of the RM website (hereinafter, the "RM Website.") Members who are admitted membership via such methods are referred to as "App Members" or "Web Members."

Article 4. Coming Into Effect of Membership

Membership shall come into effect when applicants are successfully registered with the dedicated registration system for membership application.

Article 5. Admission Fee and Annual Membership Fee

No admission fee or annual membership fee will be charged.
However, for members who are issued membership cards with a credit function (hereinafter, the "Affiliation Card"), an admission fee and annual membership fee are required in accordance with the terms and conditions established by the relevant credit card company.

Article 6. Members

Members are defined as:

  • 1. Persons who are 18 years of age or older and have, upon agreeing to these Terms and Conditions and related rules, completed the prescribed procedures that have been approved by the Company;
    Note: only individuals will be eligible to become App Members and Web Members.
  • 2. Persons who are RIHGA Royal members;
  • 3. Persons who are RIHGA Royal L'espoir Club members;
  • 4. Persons who are Royal Health Club members;
  • 5. Persons who are Royal Swimming Club members; and
  • 6. Any other persons approved by the Company.

Article 7. Revocation of Membership

  • 1. If the Company determines that any member falls under any of the following items, the Company may revoke their membership without prior notice or warning.
    Furthermore, the Company may refuse re-admission to RM in the future.
    Even if the member suffers any disadvantage or damages as a result of revocation of their membership, the Company shall assume no liability therefor unless there is any cause attributable to the Company.
    • (1) Currently correct information is not registered in the member registration data.
    • (2) False declarations or fraudulent activities are made in the declaration of accommodation record or use of privileges/services upon application for membership.
    • (3) The member has delayed payment or otherwise caused troubles with the Facilities.
    • (4) The member has not complied with the accommodation terms and conditions and other terms of use of the Facilities.
    • (5) The member has committed assault, injury, coercion, threats, extortion, fraud, or similar acts, or demanded unreasonable burden of the Facilities.
    • (6) The member is deemed to be likely to commit any act that violates laws and regulations, or public order and morals, or to cause significant inconvenience to other customers at the Facilities.
    • (7) The member is an organized crime group member, a member of or a person related to an organized crime group-related organization or other anti-social forces, or a member of a corporation or other organization whose business activities are supported by an organized crime group or its members.
    • (8) The member engages in any conduct not permitted by these Terms and Conditions, or the related rules and regulations.
    • (9) The Company determines that the member has committed any act that damages the relationship of trust between the Company and the Facilities, or if the Company otherwise deems that the member is not suitable for membership.
  • 2. If a member has not used the services or earned any points for 36 months after admission to membership, the Company shall have the right to revoke the membership of such member.

Article 8. Issuance of Membership Cards

  • 1. The Company will issue a membership card for the Program only if:
    • (1) The member has been issued a Affiliation Card;
    • (2) The member is a RIHGA Royal L'espoir Club member;
    • (3) The member is a Royal Health Club member;
    • (4) The member is a Royal Swimming Club member; and
    • (5) The Company otherwise admits the issuance thereof.
  • 2. Members who fall under any of the conditions in the preceding paragraph and who have been issued a membership card shall manage and use the membership card with the care of a prudent manager.
  • 3. Membership cards can only be used by members themselves and cannot be transferred or lent to any third party.
  • 4. If a member allows their membership card to be used by a third party in violation of Paragraphs 2 and 3 of this Article, any damages or other disadvantages incurred as a result thereof shall be borne by the member.
  • 5. An account will be created for a member who follows the admission procedures for the Program on the App or the My Page. Unless otherwise approved by the Company, no membership card as defined in Article 1 of this Article will be issued.
  • 6. A member who has registered to use the App or the My Page can use the Program by presenting the App or the My Page, which is separately recognized by the Company as a substitute for a membership card.
  • 7. App Members or Web Members shall manage and use their accounts on the App or the My Page with the care of a prudent manager, and Paragraphs 3 and 4 of this Article shall apply mutatis mutandis, with the word "membership card" replaced by "account."

Article 9. No Double Registration

Except as otherwise approved by the Company, a member may only register under one membership number.
If a member is found to have multiple membership numbers, the Company shall have the right to consolidate those membership numbers into a single number.

Article 10. Notification of Changes to Registered Information

If any changes are made to a member's registration data, the member shall notify the Company of the relevant changes without delay via telephone, the App, the My Page, or other appropriate method.
If an Affiliation Card member intends to notify of any changes in their registration data, the member shall follow the prescribed procedures in accordance with the regulations of each credit card company.
Neither the Company nor the Facilities shall have any responsibility or liability for the Company's being unable to provide privileges or services as a result of a member's failure to make such notification.

Article 11. Membership Withdrawal

If a member wishes to withdraw from membership, the member can do so by personally notifying their intention to withdraw to the RIHGA Members office or by following the withdrawal procedures on the App or the My Page.
If a member who falls under Paragraph 1, Article 8 and who has been issued a membership card withdraws from membership, the member shall, as a general rule, return the membership card to the Company.
In the event of the members' death, their family members or relatives may notify the intention to withdraw from membership.
If an Affiliation Card member wishes to withdraw from membership, they shall follow the withdrawal procedures in accordance with the regulations of the respective credit card company.

Article 12. Provision of Privileges and Membership Services

When an application for the membership privileges and services is made in the method specified in these Terms and Conditions, and related rules and regulations, the Company and the Facilities shall provide such privileges and services.
The latest information will be posted on the websites of the Company and the Facilities.

Article 13. Scope of Use of Privileges and Services

Unless otherwise specified, the membership privileges and services offered by RM shall be provided solely to members upon their personal application.
A member must present their membership card, the App, or the My Page (hereinafter, "Membership Card Presentation") to receive membership privileges and services.

Article 14. Point Program

  • 1. The total available points for each member (hereinafter, the "Accumulated Points"), increase/decrease of points, and other matters relating to points shall be managed under a management system managed and operated by a Contractor.
  • 2. As a general rule, the Accumulated Points shall be the number of points awarded under Article 15 minus the number of points exchanged under Article 16.
    However, the added points may not be reflected in the Accumulated Points until the Accumulated Points are updated in the management system.
  • 3. Accumulated Points cannot be converted into cash.
  • 4. Unless otherwise approved by the Company, points cannot be transferred or combined among members.
  • 5. A member's RM stage shall be determined according to the cumulative use result (number of points earned) of the member over the past 12 months, as defined in Paragraph 1, Article 15.
    The RM stage for each member will be updated every month.

Article 15. Grant of Points

  • 1. A member may, upon Membership Card Presentation at the Facilities, receive points specified in the following items for every 1,000 yen spent according to the membership stage on the day following the day of use (hereinafter, the "Grant of Points.")
    However, the amount spent for which the points are granted does not include taxes, local taxes, tips, and delivery fees, etc.
    Grant of Points shall be valid solely for reservations made directly with the hotel.
    • (1) Points that are awarded according to the accommodation charges, seating charges and private room charges of restaurants and bars directly run by the Company (excluding contracted stores) in accordance with the rules and regulations prescribed by the Company.
    • (2) Points that are awarded according to the price of the products sold at the stores designated by the Company (including online shopping websites; eligible stores will be disclosed on the RM Website.)
  • 2. The Company may grant a certain number of points as a special offer, with a limited time frame, by a method determined separately.
  • 3. Notwithstanding Paragraph 1 or Paragraph 2 of this Article, members acknowledge in advance that the following payments will not earn points:
    • (1) Annual membership fee for the Affiliation Cards;
    • (2) A reservation through a travel agency, booking site, etc. (excluding the Company's website and app);
    • (3) Use of accommodation coupons (including travel vouchers, etc.);
    • (4) Parking fees, minibar charges, telephone charges, massage charges, laundry charges, fax charges, visitor fees for the executive floor lounge, and lounge private room charges incurred during stay;
    • (5) Charges for floral arrangements, sound systems, and other fees incurred with the use of restaurants and bars, excluding food and beverage charges and seating/private room charges;
    • (6) Use of the RIHGA Royal Hotel online shopping site without first registering for the linked services (refers to the linkage service between the RM membership program and the membership program on the RIHGA Royal Hotel online shopping site provided by the Company);
    • (7) Usage fees for ancillary facilities;
    • (8) Usage fees for banquets, weddings, and wedding receptions;
    • (9) Purchase price of event tickets and RIHGA GIFT CHECKs;
    • (10) Annual membership fees, course fees, massage fees, and laundry fees for health clubs and the other Facilities;
    • (11) The price paid through the Point Exchange as defined in Article 16; or
    • (12) Other payments designated ineligible by the Facilities.

Article 16. Point Exchange

  • 1. If a member wishes to use points for full or partial payment of goods and services (hereinafter, the "Point Exchange"), the member shall request the Point Exchange and specify the number of points to be exchanged when purchasing goods and services at the Facilities.
    Points cannot be exchanged over the price of goods or services purchased.
  • 2. Goods and services eligible for the Point Exchange described in the preceding paragraph will be designated separately by the Company.

Article 17. Note on Point Transaction

  • 1. A member can earn or exchange points (hereinafter collectively, the "Point Transaction") when paying with cash, credit cards, debit cards, electronic money, or RIHGA GIFT CHECKs.
    However, the Point Transaction is not applicable when paying with vouchers, complimentary tickets and other free tickets.
  • 2. If a member wishes to apply the Point Transaction when purchasing goods or services, they shall notify their intent before making payment for the goods or services.
    The Point Transaction cannot be applied without prior request.
  • 3. The Point Transaction shall be applied with respect to each membership card or account, and cannot be combined even if a member has multiple cards or accounts.

Article 18. Inquiry of Accumulated Points

A member can check the Accumulated Points on the App or the My Page.

Article 19. Handling Upon Cancellation of Sales Contracts

  • 1. If a member intends to terminate or cancel a sales contract for goods or services for which the Grant of Points has been applied, the member, after Membership Card Presentation, shall take measures to have the awarded points canceled.
  • 2. If a member, after applying the Point Exchange to the payment for goods or services, terminates or cancels a past sales contract for goods or services for which the Grant of Points have been applied, the member shall pay the amount corresponding to the goods or services acquired by the Point Exchange.
  • 3. No member may cancel or return any goods or services for which the Point Exchange has been applied.
    However, a member may terminate or cancel a sales contract for the goods or services for which the Point Exchange has been applied if the reason for cancellation or return is attributable to the Company or the Facilities. The member may cancel the Point Exchange and restore the exchanged points upon Membership Card Presentation to the Facilities at which the Point Exchange had been applied within 90 days from the date of Point Exchange.

Article 20. Expiration of Points

  • 1. The valid term of points shall be until the end of the month following two years of the month in which the points were awarded as stipulated in Paragraph 1, Article 15. Points whose valid term has elapsed shall automatically expire.
    Any expired points cannot be returned to the point account.
  • 2. If a member is disqualified from membership or their membership is revoked, all points shall expire.

Article 21. Provision of Privileges and Services at Specific Facilities

A member may also receive privileges and services independently offered by specific hotels, shops and other facilities within the Facilities in addition to the privileges and services set forth in Article 12.

Article 22. Provision to Specific Members

Depending on the difference in participation requirements, use results, area of residence, and application to sales campaigns, etc., privileges, services, and information may in some circumstances be provided solely to specific members.

Article 23. Changes to Privileges and Services

Privileges and services offered at the Facilities may be terminated or changed without prior notice.
The latest information will be posted on the website of the Company and the Facilities.

Article 24. Password Registration and Duty of Management

Members shall register their password in the prescribed manner. Members shall manage their password with the care of a prudent manager to prevent it from being known to others, and endeavor to change it regularly.
Members can view or change their registered information on the App or the My Page.

Article 25. Notification of Loss or Theft of Membership Card

In the event of any loss or theft of a membership card, the member shall immediately notify the Company to that effect. Upon notification, the Company shall suspend the Point Transaction for that card.

Article 26. Suspension of Provision of the Program

  • 1. If any of the following conditions is applicable, the Company may interrupt or suspend the provision of all or part of the Program without prior notice to or consent from the members.
    • (1) Maintenance is required due to failures or malfunctions of the equipment used to implement the Program (hereinafter, the "Equipment for the Program");
    • (2) Suspension of the provision of the Program is unavoidable for financial, operational, or technical reasons;
    • (3) The Program cannot be provided due to force majeure such as natural disasters; and
    • (4) The Company deems it difficult to continue the Program with reasonable effort.

Article 27. Revisions to these Terms and Conditions

If the Company intends to revise these Terms and Conditions, it shall post the intention to revise these Terms and Conditions, the revised provisions, and the effective date on the RIHGA Royal Hotels website (URL: https://www.rihga.co.jp/) at least one month prior to the effective date of the revision.

Article 28. Handling of Personal Information

The Company shall handle members' personal information (as defined in the Act on the Protection of Personal Information) in accordance with the provisions of the Privacy Policy separately established by the Company.

Article 29. Disclaimer

Neither the Company nor the Facilities shall be liable for any damages incurred by a member in relation to RM services being used by a third party as a result of the member's willful intention or negligence.

Article 30. Governing Law

These Terms and Conditions shall be governed by the laws of Japan.

Article 31. Agreed Jurisdiction

Any and all disputes between members and the membership organization shall be subject to the exclusive jurisdiction of the Osaka District Court of first instance.

Article 32. Language To Be Used

These Terms and Conditions are originally written in Japanese. Even if these Terms and Conditions are translated into other languages, only the Japanese version shall be valid and effective as the terms and conditions.
